Briarmont Township defines the crime of trespassing as entering or remaining on someone else's property without permission or a right to do so. The offense is a misdemeanor that carries a maximum sentence of 6 months in jail and a fine of $1000.00. (Those committing OOC Trespass/Breaking and Entering/Burglary will be reported to Briarmont Township Sim Administration-Moderators by those working for The Office of The Sheriff of Hartwell County)
Trespass on Private Property Prohibited provides:
A. No person may remain upon any private property or business premises after being notified by the owner or lessee or other person in charge thereof to leave the premises.
B. No person, without the express or implied permission of the owner, the owner's agent, or the lessee, the lessee's agent, or other person in charge of private property or business premises, may re-enter any private property or business premises after having been notified by the owner, the owner's agent, or the lessee, the lessee's agent, or other person in charge thereof to keep off or keep away therefrom.
C. A letter of trespass may be issued by the Hartwell County Sheriff’s Department per the request of the owner or manager of a property. The notice must be filled out by the responding deputy. Confirmation of the notice logged by in the database should be given to the property-owner. The intended recipient must receive the letter by certified mail or hand delivered personally by a sworn deputy.
(HCSD Deputy Sheriffs should fill this out in Dispatch as: ‘Trespass Notice - Address of Location’. A copy of the notice will remain on file with the HCSD and should be logged in a complete Incident Form. (Deputies should include in the narrative the reasons behind why the trespass notice was requested)
