200 - Organizational Structure and Responsibility
200.1 PURPOSE AND SCOPE
This policy establishes the organizational structure of the Department and defines general responsibilities of office members.
Bureaus, Divisions, Units, and adjacent non-sworn departments are subject to appropriations, budgeting, funding, and staffing. Without, certain functions may be delayed, curtailed, or unable to be carried out until these issues are met and funded by the Board of Supervisors or County Commissioners.
200.2 POLICY
The roles and duties of The Sheriff are clearly defined in various sections of the Government Code of California. These duties shall be the preservation of the peace, the arrest of violators, the prevention and suppression of affrays, and investigation of public offenses. In addition, the Sheriff shall attend all sessions of the County Superior Courts, serve all processes of the Courts in compliance with the Government Code, maintain a County Jail and furnish proper custodial care for all prisoners incarcerated at the jail.
200.3 DEFINITIONS
Department — "Department" alone shall mean the Hartwell County Sheriff’s Department, its bureaus, its divisions, its units Employee or Member - "Employee" or "Member" alone shall mean the employees and volunteer personnel of the Hartwell County Sheriff’s Department.
Sworn Personnel — "Sworn Personnel" shall mean the employees of the Hartwell County Sheriff’s Department who fulfill the prerequisites as set forth in Section 830.1 of the Penal Code of the State of California.
Professional Employee — "Professional Employee" shall mean the non-sworn civilian employees not included in the term "Sworn Personnel".
Shall/Will and May — "Shall/Will" are mandatory. "May" is permissive.
Bureau — A "Bureau" is a major functional unit of the Sheriff’s Department to which divisions Bureau Commander - "Bureau Commander" shall mean the manager in charge of a Bureau.
Division — A subordinate organizational unit with the Bureau.
Division Commander — "Division Commander" shall mean the manager subordinate division of a Bureau.
Team/Unit — One or more Deputies assigned to a specific function within a Bureau or Division.
Supervisor — A member or employee of the Sheriff’s Department assigned to a position requiring the exercise of immediate supervision over activities of other members and employees.
200.4 DEPARTMENT STRUCTURE
Sheriff The Sheriff is the Chief Executive Officer and final agency authority on all matters of policy, operation, and discipline for The Office of The Sheriff and the Sheriff’s Department. The Sheriff exercises all lawful California State Constitutional roles of: Sheriff, Marshal, Constable, and Coroner. The Sheriff uses the innate powers of the Office and Department to issues such lawful orders as are necessary to assure the effective performance of the Sheriff’s Department. The Sheriff establishes, and modifies, all organizational structure. The most current organizational structure will be published via an organizational chart available to members of the Hartwell County Sheriff’s Department and the General Public. Through the Sheriff, The Office of The Sheriff and The Sheriff’s Department are jointly responsible for the enforcement of all laws and ordinances coming within its legal jurisdiction. The Sheriff is responsible for planning, directing, and co-coordinating, controlling and staffing all activities of the Sheriff’s Department for its continued and efficient operation, for the enforcement of rules and regulations within the Sheriff’s Department, for the completing and forwarding of such reports as may be required by competent authority and for the Sheriff’s Departments' relations with the citizens of Hartwell County, The Hartwell County government, The Hartwell/Briarmont Township Board of Supervisors and all other agencies and organizations. The Sheriff may perform all sworn officer duties when elected or required and when not actively working as Administration.
Undersheriff The Undersheriff is second-in-command of the Sheriff’s Department and subordinate only to the Sheriff. The Undersheriff acts in the capacity of the Chief Administrator and Executive to the Sheriff, who may, at any time, detail specific administrative and executive duties to them. During the Sheriff's temporary absence from duty, the Undersheriff may assume the duties and responsibilities of the Sheriff. At such times the Undersheriff is in supreme command, and upon them rests the responsibility of making administrative decisions and otherwise conducting the affairs as Chief Executive Officer of the Sheriff’s Department. The Undersheriff is also the College Response Bureau Commander and School Resource Officer. May perform all sworn officer duties when elected or required and when not actively working as administration. In the temporary absence of the Undersheriff, the Sheriff may select one or more executives next in the chain of command to assume such duties and responsibilities.
Captain/Chief Deputy The Captain is the Chief Deputy and is third-in-command of the Sheriff's Office and Department and subordinate only to the Sheriff and Undersheriff. Plan, direct, coordinate and review the work plan for special event operations and sheriff control needs; assign work activities, projects and programs; review and evaluate work products, methods and procedures; meet with staff to identify and resolve problems. Assume management responsibility of an assigned division within the Sheriff Department; recommend and administer policies and procedures; serve as Chief Deputy in the absence of Sheriff or Undersheriff. Study obstacles and critically observe procedures affecting the operation of their assignment and sheriff service under their direct control so that they may recommend and implement changes designed to increase their effectiveness. Review crime and accident reports for accuracy and completeness; monitor major investigations or accidents; analyze crime patterns, frequency, traffic accident patterns and other information. Oversee and coordinate a variety of operations and services functions including crime prevention, internal affairs, planning and research, DARE, vice, narcotics and special enforcement. Coordinate department activities with those of other departments, agencies and town officials; assist with planning special operations and task forces. Review and supervise the investigation of citizen complaints against sworn and non-sworn deputy sheriffs; recommend appropriate actions to be taken. Train, motivate and evaluate department personnel; provide or coordinate staff training; work with employees to correct deficiencies; implement discipline and recommend termination procedures as appropriate. Provide staff assistance to the Sheriff; participate on a variety of boards, commissions and committees; prepare and present staff reports and other necessary correspondence. Perform all duties of Deputy Sheriff, Senior Deputy/Corporal, Sergeant, Lieutenant, as required. Maintain all of the roles and responsibilities of all subordinate positions. Will perform all sworn officer duties when required and when not actively working as administration.
Lieutenant Lieutenants manage a specific division of the sheriff department; relays orders and messages from superior. Reviews sheriff reports, investigation files and logbooks to ascertain that information is recorded in conformance with regulations; determines the need for follow-up; determines appropriate distribution throughout the community. Assists subordinates in performance of duties; reviews cases with subordinates as appropriate, and provides guidance and direction. Represents the organization at various community and/or business meetings, committees, and task forces; promotes existing and new programs and/or policies. Performs miscellaneous job-related duties as assigned. Perform all duties of Deputy Sheriff, Senior Deputy/Corporal, Sergeant as required. Maintain all of the roles and responsibilities of all subordinate positions as defined below. Will perform all sworn officer duties when required and when not actively working as administration.
Sergeant Sergeants identify training deficiencies and provide or coordinate staff training; work with employees to correct deficiencies. Review the work of assigned personnel to ensure compliance with department policies and procedures; review and approve a variety of case reports submitted by deputy sheriffs. Adhere to methods for providing law enforcement, traffic control, crime prevention, and administrative services; identify resource needs; review needs with appropriate management staff; allocate resources accordingly.
Supervise the control of traffic flow, traffic violators, and issuance of traffic citations.
Recommend and assist in the implementation of goals and objectives; implement approved policies and procedures. Perform all duties of Deputy Sheriff, Senior Deputy/Corporal as required. Maintain all of the roles and responsibilities of all subordinate positions. Will perform all sworn officer duties when required and when not actively working in supervisory capacity.
Detective: Detective Corporal, Detective Sergeant, Detective Lieutenant Detectives investigate criminal acts such as homicides, sexual assaults, armed robberies, home invasions, and property crimes such as burglaries. Process crime scenes. Collect and use forensic evidence to solve crimes, including fingerprints, DNA, physical evidence, etc. Interview informants, suspects, and witnesses to ascertain alibis, clues, time frames, and possible suspects. Processes evidence, prepares court cases, and provides legal testimony. Maintain detailed records of all investigations. Perform surveillance and monitor suspects. Exchange information and coordinate activities with other departments.
Participates in department programs and events and represents the department in a positive light. Will perform all sworn officer duties when required and when not actively working an investigation. Detectives primarily work in the Major Crimes Bureau in general, or specifically in Criminal Investigations Division, Vice and Narcotics Division, Missing Persons Unit, SART Unit.
Senior Deputy/Corporal A Senior Deputy bearing the rank of Corporal has passed the Hartwell County Sheriff Department Deputy Training Program. Assumes the duties of the shift supervisor including scene supervision, administrative duties, personnel management, document and report approval, scheduling, and maintaining staffing levels, and record keeping and documentation in the absence of the assigned Sergeant. Plans, reviews and assists with the patrol of an assigned area to preserve law and order, prevent, identify and investigate crimes, and enforce laws, regulations, and ordinances. Provides input on the evaluation of staff, recommending improvements and modifications. Serves as Field Training Officer by training and providing technical assistance to Deputy Sheriff; documents performance and training needs; reviews and approves reports. Maintain all of the roles and responsibilities of Deputy Sheriff. Will perform all sworn officer duties when required and when not actively advising. The grade of Detective opens for those who have earnt the rank of Corporal.
Deputy Sheriff Deputy Sheriffs protects life and property through the enforcement of laws & regulations; Performs all sworn officer duties to which is: proactively patrols assigned areas; prevents and investigates illegal activities, domestic disturbances, accidents, etc. Responds to calls for law enforcement or peace officer service. Conducts preliminary & follow-up criminal and traffic investigations. Conducts interviews where necessary. Prepares written reports and field notes of investigations and patrol activities. Arrest and process criminals. Write citations, deliver warrants, and testify in court proceedings. Perform necessary emergency duties required during adverse weather conditions or in emergency situations, able to exercise judgment in determining when to use force and to what degree. Operate a law enforcement vehicle under emergency conditions day or night. Comprehend and write legal documents including citations, affidavits, warrants and other documents. Command emergency personnel at accident emergencies and disasters. Takes an active role in Community Oriented Policing. Participates in department programs and events and represents the department in a positive light. Perform under the supervision of a Field Training Officer or member of the Administration Staff. May perform foot patrols, mounted patrols or vehicle patrols on their own as a way to get to know the community. May act as bailiff during their deputy sheriff period. May act as Jail/Detention/Correctional Deputy when ordered by the Sheriff’s Department Administration or ranking Deputy Sheriffs. Will remain in the Deputy Sheriff phase to finish required, necessary department In-service training and qualify for department standards. When completed, the Deputy Sheriff will have earnt the role of Senior Deputy and compulsory rank of Corporal.
Non-Sworn Office Employee/Office Manager This member of the Sheriff’s Department is professional employee who serve as the first point of contact for the Sheriff’s Department (in-person, email and telephone) responding to a wide variety of questions, completing requests and/or directing to the appropriate personnel. Provides responsible assistance and support to the Sheriff, Undersheriff, and Captain/Chief Deputy, with a variety of administrative and management functions as assigned. Work involves preparing a variety of statements, correspondence, reports, files and records; obtaining information for reports from the general public; and providing information to departmental personnel, other agencies and the general public. Schedule and/or directs individual(s) to appropriate person or office. Discern issues on the phone that may require immediate attention from someone in the office. Take on other duties as needed or ordered by the Office of The Sheriff as well as functioning as: Administrative Bureau, Personnel/Human Resources, Public Administrator, Public Information Officer, Custodian of Records/Records Manager. This role is set for expansion. The Non-Sworn Office Manager may elect to carry a sidearm under the direct authority of the Sheriff and their CCW without penalty.
Bureau Commander A Bureau Commander is an executive officer of the Sheriff’s Department, generally but not always, a Lieutenant who commands the activities of an entire Bureau in accordance with the policies prescribed by the Sheriff. It is their duty to aid, advise and cooperate with the Sheriff and Undersheriff in the implementation and enforcement of all general administrative, operational, and policy matters.
Division Commander A Division Commander is generally a Sergeant of the Sheriff’s Department who commands the activities of their division(s), under the direction of their Bureau Commander or the Undersheriff, in accordance with the policies prescribed by the Sheriff. It is their duty to aid, advise and cooperate with the Sheriff, Undersheriff, and Bureau Commander in general administrative and operational matters and determining matters of policy.
In the absence of a Division Commander, the next level up will be in charge unless otherwise directed by the Sheriff or Undersheriff.
In addition to the general and individual responsibilities of all members and employees, the Division Commander is specifically responsible for the following:
GOOD ORDER - The general good order of their command during their tour of duty is to include proper discipline, conduct, welfare, field training, and efficiency.
REPORTING - Reporting as required by higher authority. Maintenance of such records as specified by higher authority.
PERSONNEL COMPLAINTS - Inquiring into personnel complaints against members and employees under their command in accordance with the orders of the Sheriff’s Department.
200.5 CHAIN OF COMMAND AND CONTROL
Lines of control permitting the delegation of authority, the placing of responsibility, the supervision of operations, and the coordination of effort are hereby established in conformity with the organizational chart. Absent specific direction from the Sheriff, the general chain of command shall be as follows:
Sheriff Undersheriff Captain/Chief Deputy Lieutenant Sergeant/Supervisor Detective (Detective Corporal, Detective Sergeant, Detective Lieutenant) Senior Deputy/Corporal/Advisor/Field Training Officer Deputy Sheriff Office Personnel/Office Employee/Office Manager All official communications of the Sheriff’s Department, whether moving downward, or requests, information, suggestions or complaints, moving upward, shall be confined to official channels. Each link in the chain of command shall be respected in this regard. It shall be the responsibility of each echelon to forward communications in a timely manner to the next higher echelon, with their approval, disapproval or recommendations.
Employees of the Sheriff’s Department shall transact official business through the channels commencing with the immediate supervisor, who, if they find it is not a matter which can be handled by them, will give permission to the employee to submit their request in writing to the proper supervisor, and the immediate supervisor shall forward the request to the next supervisor with their comments. In emergencies where the immediate superior cannot handle the matter, they will instruct the employee to make verbal contact with the next available supervisor. This rule does not deny an employee the privilege of contacting the Sheriff, Undersheriff, Bureau Commander, or Division Commander on matters of a strictly personal nature.
200.6 COMMAND PROTOCOL
200.6.1 SUCCESSION OF COMMAND
The Sheriff exercises command over all personnel in the Sheriff’s Department. During planned absences the Sheriff will designate the Undersheriff to exercise command. The order of command authority in the absence or unavailability of the Sheriff and Undersheriff is the Captain/Chief Deputy followed by the most senior Bureau Commander.
200.6.2 UNITY OF COMMAND
The principles of unity of command ensure efficient supervision and control within the Office. Generally, each employee shall be accountable to one supervisor at any time for a given assignment or responsibility. Except where specifically delegated authority may exist by policy or special assignment (e.g., K-9, SWAT), any supervisor may temporarily direct any subordinate if an operational necessity exists.
200.6.3 ORDERS
Members shall respond to and make a good faith and reasonable effort to comply with the lawful order of superior officers and other proper authority.
200.7 POLICY
The Hartwell County Sheriff’s Department will implement and maintain an organizational structure that provides clear and identifiable roles for command, control, and guidance of the Office. Each position and assignment should have clearly identified responsibilities and a defined chain of command.

200.8 ORGANIZATIONAL CHART
The Sheriff or the authorized designee is responsible for developing and maintaining an organizational chart which shall be accessible to all members. The organizational chart shall be reviewed and updated annually and whenever structural changes occur. The Current Bureaus of the Sheriff’s Department are as follows:
Administration Bureau ADMINISTRATION BUREAU The Administration Bureau of the Hartwell County Sheriff Department is composed of the Sheriff and Undersheriff. The division will eventually also include a Captain / Chief Deputy that directly oversees the daily operations of each division and also includes the non-sworn office employee within the department who reports directly to the Sheriff or Undersheriff. Administration Bureau: Sheriff, Undersheriff, CPT, NSE Training Division: Undersheriff, CPT, LT Professional Standards Division: LT, SGT, CPL Sheriff-Coroner's Office: Sheriff; Coroner; The Peace Officer position of Coroner is to be outsourced to Hartwell General Chief-of-Staff's physician, Medical Examiner designee. They carry the equivalent authority of Chief Deputy of the Office of The Sheriff.
Non-Sworn Office Employee/Office Manager (absorbs the roles and duties of Administrative Bureau, Personnel/Human Resources, Public Administrator, Public Information Officer, Custodian of Records/Records Manager) Patrol Bureau PATROL BUREAU The Patrol Bureau will be led by a ranked deputy, who will oversee the various units within the division and its appointed squads. Each Patrol Division squad will be localized to a district in Hartwell County: Ashenfall, Brackenridge, Briarmont, Emberglow, Thornmere, Solarus and is supervised directly by an administrative ranked deputy sheriff. The Patrol Division also include Mounted Deputy Units and Traffic Division. Planned units, to-be-determined with staffing and funding are: K-9 Unit, Aviation Unit, and Marine Unit.
Patrol Operations Bureau: LT, SGT, CPL Mounted Patrol Unit Division: LT, SGT, CPL, Deputy Sheriff Traffic Division: SGT, CPL, Deputy Sheriff K9 Unit: SGT, CPL, Deputy Sheriff Marine Unit: SGT, CPL, Deputy Sheriff Ashenfall District: SGT, CPL, Deputy Sheriff Brackenridge District: SGT, CPL, Deputy Sheriff Briarmont District: SGT, CPL, Deputy Sheriff Emberglow District: SGT, CPL, Deputy Sheriff Thornmere District: SGT, CPL, Deputy Sheriff Solarus District: SGT, CPL, Deputy Sheriff Civil Services Bureau CIVIL SERVICES BUREAU/COURT PROTECTION DIVISION/BALIFF This or these Deputy Sheriff(s) are/is court security officer(s) who will primarily localize their patrol to the Superior Court in Thornmere and the Hartwell County Sheriff Department.
Deputies of this division are understood to provide courthouse security, courtroom order and security, protection of the judges, court staff, public and prisoner handling, and movement between the Hartwell County Jail and the Superior Court.
They may also be tasked to serve civil services process paperwork or serving warrants. Court Services Bureau: LT, SGT, CPL Court Security Division: SGT, CPL, Deputy Sheriff Baliff: Deputy Sheriff or higher Major Crimes Bureau MAJOR CRIMES BUREAU The Major Crimes Bureau is led by a ranked deputy sheriff, who oversees the various units within the division and its appointed squads. The Investigations Division is a detective division that is run by a Detective Sergeant or higher.
The Major Crimes Bureau is responsible for the investigation of major crimes and felonies, and any complicated crimes beyond the expertise of Patrol Bureau personnel. They are expected to maintain discretion when handling pertinent information and treat both victims and suspects with the utmost respect.
Established Divisions inside the Major Crimes Bureau: Criminal Investigations, Vice and Narcotics, Missing Persons.
Detectives are responsible and encouraged to investigate potential concerns and red flags within the community and utilize the various means of obtaining evidence at their disposal. This may include undercover work, surveillance, communication with informants, etc.
Major Crimes Bureau Commander: LT, SGT, CPL Criminal Investigations Division: LT, SGT, CPL Vice and Narcotics Division: LT, SGT, CPL Missing Persons Unit: LT, SGT, CPL SART Unit: LT, SGT, CPL School Resource/College Response SCHOOL RESOURCE/COLLEGE RESPONSE BUREAU An Oakridge College focused unit working in concert with the President and the administration of Oakridge College as well as the college fraternities and sororities. The Undersheriff is the School Resource/College Response Bureau Commander and will primarily localize their patrol at the college and the Greek Row.
School Resource Officer/College Response Bureau: Undersheriff, CPT, LT, SGT, CPL, Deputy Sheriff Crisis Response/Special Weapons and Tactics CRISIS RESPONSE UNIT/SPECIAL WEAPONS AND TACTICS TEAM The Hartwell County Special Weapons and Tactics (SWAT) team trains in special tactics and rescue services so they can respond to the people of Hartwell County and assist at a moment's notice. The team specializes in serving high-risk arrest warrants, hostage rescue, and responding to active shooters. SWAT is a job available to deputy sheriffs and team members must be diligent so they can perform SWAT duties in addition to regular patrol.
